Terms of Service
For businesses that sign up to Click & Collect Websites, by Norwich Website Design Ltd. Last updated 22nd October 2026.
These terms apply when your business signs up to Click & Collect Websites. They’re written in plain English. You accept them by ticking a box when you sign up, before any payment is taken.
The Data Processing Agreement in Schedule 1 is part of these terms, so you accept both with one tick.
1. About these terms
1.1 These terms are an agreement between Norwich Website Design Ltd (registered in England, company number 17355394, registered office 21 Cranleigh Rise, Eaton, Norwich, NR4 6PQ, VAT number 525648866), trading as Click & Collect Websites (“we”, “us”), and the business that signs up (“you”).
1.2 The agreement starts when you pay the Setup Fee and accept these terms at checkout.
1.3 This is a business-to-business service. By signing up you confirm you are acting for your business, not as a private consumer.
1.4 Words with special meanings:
| Term | Meaning |
|---|---|
| Service | Everything we provide under these terms: the build, hosting, software, updates and support. |
| Package | Either the Ordering Shop or the Shop + Website, as described in Schedule 2. |
| Your Shop | The ordering shop (and, for Shop + Website, the website) we build and host for you. |
| Setup Fee | The one-off fee for building Your Shop: £750 + VAT (Ordering Shop) or £2,500 + VAT (Shop + Website). |
| Monthly Fee | £45 + VAT a month for hosting, software and support. |
| Billing Start Date | 28 days after you sign up: the day your first Monthly Fee is taken (see clause 5.3). |
| Ready Date | The day we tell you Your Shop is ready to launch (see clause 4.4). |
| Setup Form | Our online form where you give us your products, collection times, branding and other details. |
| Customer Data | Personal data about your customers that Your Shop collects, such as names, emails, phone numbers and orders. |
2. What we provide
2.1 The build. We set up Your Shop for the Package you chose, as listed in Schedule 2. This includes loading all your products for you, your collection points and times, payment options, order emails, a test order with you and one hour of training.
2.2 Each month, the Monthly Fee covers:
- hosting, a security certificate and daily backups;
- WordPress, theme and BoxCart Pro updates;
- security monitoring;
- support for the ordering system (clause 9).
2.3 Not included unless you buy it separately: changes to your content or design, new pages, extra features, search engine optimisation work, product photography and copywriting.
2.4 The software. Your Shop runs on WordPress and BoxCart, which we develop. We may improve or change features over time, but we won’t remove a feature you rely on without telling you first and offering a reasonable alternative.
3. What we need from you
3.1 To build Your Shop we need you to:
- complete the Setup Form, including your product list, prices (if you show them), collection points, days and times;
- send your logo, brand colours and product photos;
- add one DNS record with your domain provider when we ask (we send exact instructions), or give us access to do it;
- reply to our questions within 3 working days.
3.2 We start building once the Setup Form is complete. Our timescales (clause 4) run from that point.
3.3 Your content is your responsibility. You confirm you have the right to use everything you send us (photos, logos, text), and that your product information, prices, allergen details and opening times are accurate and kept up to date.
3.4 Selling food is your responsibility. You remain responsible for food safety, allergen information, labelling, pricing law, and your own terms of sale and privacy notice for your customers. We can provide templates, but we don’t give legal advice.
3.5 You keep your login details safe and tell us straight away if you think someone else has access to your account.
4. Timescales and going live
4.1 We aim to have Your Shop ready within 10 working days of your Setup Form being complete. This is a target, not a guarantee.
4.2 The clock pauses while we’re waiting for something from you, such as missing products, photos, answers or the DNS record. Your Monthly Fee still starts on the Billing Start Date (clause 5.3).
4.3 Christmas intake. If you sign up by 17th November 2026 and complete the Setup Form within 5 working days of signing up, we will have Your Shop ready to take orders by 1st December 2026. If we miss that date through our own fault, your first Monthly Fee is free.
4.4 Ready to launch. When Your Shop is ready we tell you by email and walk you through it, including a test order. You then tell us when to open it to your customers.
4.5 Once Your Shop is live, changes to your content or design aren’t included in the Monthly Fee (clause 2.3). Just ask and we’ll give you a price.
5. Fees, payment and VAT
5.1 All prices exclude VAT, which is added at the current rate (20%).
5.2 Setup Fee. You pay the full Setup Fee by card when you sign up, through our payment provider, Stripe.
5.3 Monthly Fee. At sign-up you also start a monthly subscription on the same card. Your first Monthly Fee is taken on the Billing Start Date, 28 days after you sign up, and then on the same date each month. We aim to have Your Shop ready well before then (clause 4.1).
- If we’re running late: if Your Shop isn’t ready by the Billing Start Date because of something on our side, we move your Billing Start Date back to the Ready Date. You don’t pay a Monthly Fee before Your Shop is ready.
- If we’re waiting on you: if Your Shop isn’t ready because we’re still waiting for your Setup Form, content, answers or DNS record (clause 3), your Monthly Fee starts on the Billing Start Date as normal.
Your Shop counts as ready from the Ready Date, whether or not you have opened it to your customers yet.
5.4 Card payments only. We take payment by debit or credit card (including Apple Pay and Google Pay) through Stripe. Stripe sends your receipts and VAT invoices by email.
5.5 Failed payments. If a payment fails, Stripe retries it and we let you know. If it is still unpaid 14 days after it was due, we may suspend Your Shop (it stops taking orders but nothing is deleted) until it is paid.
5.6 Price changes. We won’t change the Monthly Fee during your first 12 months. After that we give you at least 60 days’ notice of any increase, and you can cancel before it takes effect.
5.7 Your customers’ payments (if you take cards in Your Shop) go straight to your own Stripe account. We never hold your customers’ money. Stripe’s own fees and terms apply to that account. We don’t charge commission or per-order fees.
6. Minimum term and cancelling
6.1 Minimum term: 12 months from the Billing Start Date. After that the agreement continues month to month until either of us ends it.
6.2 After the minimum term, you can cancel with 30 days’ notice by email. The last Monthly Fee covers your final month; we don’t charge for part months.
6.3 Cancelling during the minimum term. You can, but the Monthly Fees for the rest of the 12 months become due.
6.4 Cancelling before the Billing Start Date is covered by the refund rules in clause 7, and no Monthly Fees are due.
6.5 We can end the agreement with 14 days’ written notice if you:
- haven’t paid an amount more than 30 days after it was due; or
- seriously break these terms and don’t put it right within 14 days of us asking.
6.6 We can also end it for any reason with 90 days’ notice. If we do, we refund any fees paid for time after the end date and help you move Your Shop elsewhere (clause 8).
6.7 However the agreement ends, clause 8 (ownership and leaving) applies.
7. Refunds of the Setup Fee
The refund depends on how far the build has gone when you cancel:
| When you cancel | Refund of the Setup Fee |
|---|---|
| Within 14 days of signing up, and before you complete the Setup Form | Full refund |
| After you complete the Setup Form, before we tell you Your Shop is ready | 50% refund |
| After we tell you Your Shop is ready, or after go-live | No refund |
7.1 If we can’t deliver Your Shop for a reason that is our fault, we refund the Setup Fee in full.
7.2 Refunds go back to the card you paid with, within 14 days of us agreeing them.
7.3 Monthly Fees already paid are not refunded, except under clause 6.6.
8. Ownership and leaving
8.1 You own: your domain name, your content (products, photos, text, logo), and all Customer Data and order history.
8.2 We own the BoxCart software and our own tools and templates. While the agreement runs, we give you the right to use them as part of Your Shop.
8.3 Your website. For Shop + Website, once the minimum term has ended and all fees are paid, you can take a full copy of your website with you and keep using it. WordPress and the theme are open-source (GPL) software.
8.4 The BoxCart Pro licence stays with us. Your Shop runs on our licence. If you leave, Your Shop can switch to the free version of BoxCart (from WordPress.org), or you can buy your own BoxCart Pro licence to keep the Pro features.
8.5 When you leave, we will:
- export your products, customers and orders in a standard format (CSV);
- on request, provide a full copy of your website files and database;
- help your new web host with the move for up to 1 hour at no charge (more time is charged at our hourly rate);
- keep Your Shop online for 30 days after the end date so you have time to move, then delete it and all Customer Data within a further 30 days, unless the law requires us to keep something.
8.6 If you haven’t paid what you owe, we can hold back the website copy (but never your Customer Data) until you have.
9. Hosting, support and availability
9.1 Support covers help with using the ordering system and fixing faults in it. Contact us by email at hello@boxcart.dev or hello@norwichwebsite.design.
9.2 Backups. We back up Your Shop daily and keep backups for at least 14 days.
9.3 Updates and maintenance. We keep WordPress and plugins up to date. Planned maintenance is done at quiet times where possible, and we give notice of anything likely to take Your Shop offline for more than 30 minutes.
9.4 Availability. We use reasonable care to keep Your Shop online, but we can’t promise it will never be unavailable. Hosting, email delivery, domain providers, Stripe and internet connections are run by others.
10. Your customers’ data
10.1 For Customer Data, you are the controller and we are your processor under UK data protection law. We only use Customer Data to run Your Shop for you, as set out in Schedule 1.
10.2 You are responsible for having a privacy notice for your customers and a lawful reason to process their data. We provide a template privacy notice you can adapt.
10.3 Improving our service. We may collect anonymous, aggregated information about how Your Shop is used (for example, how many people leave at checkout, or errors on a page) to fix problems and improve BoxCart. This never includes names, contact details or anything that identifies a person.
10.4 Our own handling of your details (as our customer) is covered by the Norwich Website Design privacy policy.
11. Acceptable use
You agree not to use Your Shop or our hosting to:
- sell anything illegal, or age-restricted goods without proper age checks;
- publish content that is unlawful, misleading, or infringes someone else’s rights;
- send spam or unsolicited marketing;
- interfere with our systems or other customers’ sites.
If you do, we may take the content down or suspend Your Shop, and we will tell you why.
12. Liability
12.1 Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn’t allow to be limited.
12.2 We are not responsible for:
- lost profits, lost sales, lost orders or loss of goodwill;
- problems caused by things outside our control, such as Stripe, email providers, your domain provider or your internet connection;
- the accuracy of your content, prices or allergen information;
- disputes between you and your customers.
12.3 Our total liability under this agreement in any 12-month period is limited to the fees you paid us in that period.
12.4 You are responsible for any claims against us that arise from your content or your products.
13. General
13.1 Changes to these terms. We may update these terms. We email you at least 30 days before a change that affects you. If you don’t agree, you can cancel before it takes effect without paying the rest of the minimum term.
13.2 Things outside our control. Neither of us is responsible for delays caused by events beyond our reasonable control.
13.3 Transfer. You can’t transfer this agreement without our agreement. We may transfer it to another company that takes over the service, and we’ll tell you if we do.
13.4 Notices are sent by email: to hello@boxcart.dev or hello@norwichwebsite.design for us, and to the email you signed up with for you.
13.5 Whole agreement. These terms, the Schedules and your checkout order are the whole agreement between us.
13.6 Law. These terms are governed by the law of England and Wales, and the courts of England and Wales deal with any dispute.
Schedule 1: Data Processing Agreement
This schedule sets out the terms UK GDPR Article 28 requires when we process Customer Data for you.

- make sure anyone who handles it is bound by confidentiality;
- keep it secure with appropriate measures, including encrypted connections, access controls, daily backups and security updates;
